Employment Standards Compliance
In British Columbia, the Employment Standards Act provides employees with basic rights regarding hours of work, overtime, vacations, public holidays, termination pay, pregnancy and parental leave, and so on. These are important rights to which most employees are entitled, even if employers are not always aware of these entitlements.
Employment contracts are among the most important legal documents that individuals have to sign in their lifetimes. Despite this, most employees do not take the time to understand properly what their employment contract provides. Duty to Accommodate
When an employee is unable to perform his or her job due to religious reasons, as a result of a disability (either physical or psychological), because of child care or due to other constraints, the employer must provide assistance to the employee. This may mean changing the job requirements, providing someone to help the employee perform job duties, or making changes to shifts.
Discrimination and Harassment
The British Columbia Human Rights Code provides that everyone has the right to be free of discrimination based on race, ethnicity, religion, disability, place of origin, sex, sexual orientation, age, family or marital status, among other prohibited grounds.
This legislation also prohibits harassment on the basis of any of these grounds, such as racial or sexual harassment. We speak with many employees who have been subject to mistreatment by their employers or co-workers. These can be very serious matters that can greatly affect an individual’s health and well-being. The law mandates that we are all entitled to work in harassment-free workplaces and that an employer has a positive obligation to create an environment appropriate for working.
